Welcome to Botiex. These Terms of Service ("Terms") govern your use of the Botiex website at www.botiex.com and our AI chatbot platform (the "Service") operated by Botiex, Inc. ("we", "our", "us").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 16 years old to use the Service
• One person or business may not maintain more than one free account
• You are responsible for all activity that occurs under your account

2. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

• Use the Service to distribute spam, malware, or harmful content
• Attempt to reverse engineer, decompile, or disassemble the Service
• Interfere with or disrupt the integrity or performance of the Service
• Access the Service through automated means (bots, scrapers) without our permission

You retain ownership of all content you upload, submit, or create through the Service ("Your Content"), including business data, documents, and chatbot configurations.

3.2 License to Us

By uploading content to the Service, you grant us a limited, non-exclusive license to use, process, and store Your Content solely for the purpose of providing and improving the Service. This license terminates when you delete Your Content or your account.

3.3 Responsibility

You are solely responsible for Your Content and ensuring it does not violate any third-party rights, applicable laws, or these Terms. You represent that you have all necessary rights and permissions to use and share Your Content through the Service.

4. AI-Generated Responses

• The Service uses artificial intelligence to generate chatbot responses based on data you provide
• AI-generated responses may occasionally be inaccurate, incomplete, or inappropriate
• You are responsible for reviewing and monitoring your chatbot's responses
• We do not guarantee the accuracy, reliability, or suitability of AI-generated content
• You should not rely on the Service for medical, legal, financial, or emergency advice

5. API Keys and Widget Embedding

• API keys provided to you are confidential and should not be shared publicly
• You are responsible for all usage associated with your API keys
• We reserve the right to revoke API keys that are abused or used in violation of these Terms
• The embedded widget must not be modified to remove or obscure Botiex branding where required by your plan

6. Service Availability

• We strive to maintain high uptime but do not guarantee uninterrupted access to the Service
• We may perform scheduled maintenance with reasonable advance notice
• We reserve the right to modify, suspend, or discontinue any part of the Service at any time
• We are not liable for any downtime, service interruptions, or data loss

7. Fees and Payment

• Free tier users are subject to usage limits as described on our pricing page
• Paid plans are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by applicable law
• We reserve the right to change pricing with 30 days' advance notice
• Failure to pay may result in suspension or termination of your account

8. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is owned by Botiex, Inc. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our express written permission.

9. Termination

• You may terminate your account at any time by contacting us or deleting your account
• We may suspend or terminate your access if you violate these Terms
• Upon termination, your right to use the Service ceases immediately
• We may retain certain data as required by law or for legitimate business purposes
• Sections of these Terms that by their nature should survive termination will survive

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTIEX, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION OR THEORY OF LIABILITY.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Botiex, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, Your Content, or your violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Delaware.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
